daycare
the need to know asked:

My daughter is in daycare. I pay half of the daycare. The mother gets to claim her this year. Can I claim my part of daycare even though she is claiming her as a dependant?

  1. v b says:

No. You must be able to claim the exemption as a custodial parent to take this credit.

  2. HelpCharlie says:

Nope, sad but true, have to be able to claim the child on the form to take any of the credit. There’s always next year.

  3. Judy says:

It doesn’t matter which parent is claiming her this year. The parent she lives with for the greater part of the year can claim child care expenses. The other parent can’t even if they are the one claiming her as a dependent.

Both other answers so far are incorrect.
